WORKER FALLS 10 STORIES TO HIS DEATH IN MIDTOWN CONSTRUCTION ACCIDENT

A construction worker fell 10 stories to his death while working on a building at 434 West 33rd Street in Manhattan in a fatal Midtown construction accident.

Authorities said that the man was working on the 12th floor of the building when he fell 10 stories to the scaffolding below. He was taken to Bellevue Hospital, where he was pronounced dead on arrival.

According to the NYC Department of Buildings, the site has two open safety complaints and 41 open violations.

Construction sites like these constitute a workplace safety issue for construction workers, and there has been an increase in the number of New York City construction accidents over the past few years. While construction workers should be covered by Workers’ Compensation, in some instances the compensation is inadequate to cover the loss of wages and future job opportunities, medical care and other injury-related expenses.

In addition, if a construction accident is caused by someone other than the employer (such as a subcontractor), a lawsuit can be brought against the subcontractor even if workers’ compensation covers the accident.
